Two Paths to a Conviction — Defense From a Mecklenburg County DUI Lawyer

Under North Carolina DWI laws, there are two paths to a DWI conviction:

  • Failure of a chemical test, such as a breathalyzer test: A blood alcohol level (BAC level) of .08 or higher can result in a conviction.
  • Appreciable impairment: No chemical test is required for this type of conviction, which is based on failed field sobriety tests, appearance of intoxication, driving pattern or other conditions that indicate alcohol impairment.
